The Data Protection Declaration of the ALBERTINA Museum
1. Administration of the Competition
The Albertina offers the opportunity to participate in competitions. By participating in the respective competition, the participant (hereinafter referred to as “Participant”) agrees to the following terms and conditions of participation and fully acknowledges them. Legal recourse is excluded. Any liability in connection with competitions towards the Albertina is excluded. Cash payment or transfer of the prize to another person is also excluded. Only persons who meet the following criteria will be considered in the selection of winners:
- Residence in Austria
- Completion of the 14th year of age
- Correct and legible provision of personal data after notification of winning (first name, last name, email address, if applicable date of birth)
- An active account on the social media platform on which the competition takes place
In the event of winning, participants will be contacted exclusively via message on the social media platform on which the competition was published and must respond to the notification of winning within 7 days; otherwise, an alternative winner will be determined.
For time-limited competitions, compliance with the deadline is determined by the electronically logged receipt or the time at which the comment was posted on the respective social network.
Participants who provide false or incorrect personal information may be excluded from the competition by the Albertina.
Data Protection
The participant is responsible for the accuracy of the data provided. In the event of incorrect information, the organizer is entitled not to award the prize or to appoint a substitute winner. The data provided by the winner (first name, last name, email address) will be processed electronically by the organizer and its cooperation partner named in the competition for the purpose of conducting and administering the competition, for the duration of the competition and beyond in accordance with any applicable legal provisions.
The participant expressly agrees to the processing of their data in the course of participating in the competition.
The participant is entitled to assert their rights pursuant to Articles 15 to 21 GDPR by email to . For this purpose, the organizer may request further cooperation measures. No automated decision-making takes place and the participant may lodge a complaint against the processing of their data with the Austrian Data Protection Authority.
2. Eligibility
Participation is free of charge and is not linked to a purchase or visit.
Employees of the Albertina are excluded from participation.
Multiple entries are permitted. However, a maximum of one prize will be awarded per participant. Participation via third parties, such as competition associations or automated services, is not permitted. In the event of suspected manipulation of the competition, violation of these terms and conditions of participation, or violation of statutory provisions, the organizer reserves the right to exclude participants. In such a case, there is no entitlement to further participation and prizes already confirmed shall lapse or prizes already handed over must be returned.
3. Conditions of Participation, Release from Liability and Granting of Rights
By participating, the participant confirms that their submission (image material) does not infringe the rights of third parties, in particular copyrights, neighboring rights, rights of use or personal rights. If persons other than the participant were involved in the creation or development of the submission, the participant must obtain their consent to the submission prior to submission.
Participants are liable for ensuring that the photos they upload do not violate applicable laws or infringe the rights of third parties. Photos that violate common decency or give rise to suspicion of violating the above-mentioned rights or competition criteria will be excluded from participation and the relevant material will be deleted.
The Albertina is under no obligation whatsoever to conduct investigations regarding any submission by a participant. Each participant is obliged to indemnify and hold harmless the organizer of the competition in connection with any copyright infringements.
The participant grants express permission for the organizer to use and publish the submitted material for further promotional purposes as well as the submitted images on websites, on social networks (for example on the Albertina Instagram wall and the Albertina Facebook page) and in print media within the framework of the competition. The organizer reserves the right to promptly review the submitted material and examine it according to the above-mentioned criteria. By uploading the submission, the participant also agrees to the terms and conditions of Instagram/Facebook, for which the organizer and thus the Albertina assume no liability.
4. Description of Prizes
The prizes are specified on the participation page of the respective competition.
Cash payment or exchange of the prizes is not possible. Prizes are non-transferable. The prizes may differ in color, features and quality from those shown in the promotional materials. The winners will be determined non-publicly by the Albertina. The winners will be notified within one week after the end of the competition.
5. Right of Amendment, Exclusion of Participants
The organizer reserves the right at any time to amend the competition procedure or the terms and conditions of participation, to suspend them temporarily, or to cancel the competition entirely. The organizer also reserves the right at any time to replace the prizes with prizes of equal or higher value.
6. Liability
Upon handing over the prize, the Albertina shall be released from all obligations, unless an earlier point in time results from these provisions.
The Albertina shall not be liable for material and/or legal defects in prizes donated by any cooperation partners.
The Albertina shall only be liable for damages caused by itself or its vicarious agents intentionally or through gross negligence.
The Albertina assumes no liability for any damage or loss arising from participation in the competition or from acceptance of the prize.
This exclusion of liability does not apply in the event of culpable injury to life, body or health, for claims under the Product Liability Act, or if the circumstance giving rise to liability was fraudulently concealed. Insofar as the liability of the Albertina is excluded or limited, this shall also apply to the personal liability of its executive bodies, employees, representatives and vicarious agents.
The organizer assumes no liability for interruptions, termination, failure, deletion, error or delay in operation or transmission or similar events. The organizer shall also not be liable for changes to entries or unauthorized access to entries or for entries that are lost due to technical problems during transmission as a result of server functionality or for other reasons beyond the organizer’s control. Furthermore, the organizer shall not be liable for damage to participants’ hardware or software caused by participation in the competition or resulting therefrom.
7. Final Provisions
Legal recourse is excluded. Austrian law shall apply exclusively.
Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
